Terms and Conditions

1. General

These terms apply to all graphite portrait commissions carried out by Sharon van Voorst, the artist.

By submitting a request, the customer agrees to these terms.

The commission officially starts after the deposit has been received.

2. Reference photos

The customer provides at least two clear reference photos for the portrait.

The photos should be:

  • sharp and clearly visible
  • well lit
  • detailed enough
  • suitable for artistic interpretation

The artist reserves the right to refuse a commission if:

  • the quality of the photos is insufficient
  • the request does not fit the artistic working method
  • communication or collaboration becomes problematic
  • the content is inappropriate or conflicts with these terms

3. Artistic interpretation

All portraits are drawn entirely by hand in graphite, based on artistic interpretation of the supplied reference photos.

Composition, tonal values, cropping and artistic execution remain part of the artist's creative freedom.

The final result is not an exact copy of a photo, but a handmade artwork based on observation and interpretation.

Small natural variations and subtle irregularities are part of the handmade character of the work.

Depending on lighting and viewing angle, graphite drawings may differ subtly in appearance and contrast.

4. Payment

A 50% deposit is requested before the portrait starts.

The remaining 50% is paid after approval of the preview and before shipping.

Until full payment has been received, the artwork remains the property of the artist and will not be shipped.

5. Cancellation

A request can be cancelled free of charge before the deposit has been paid.

After the deposit has been received and the drawing process has started, the full agreed amount is due.

Because the work is completely handmade and personal, cancellation is no longer possible after the process has started.

6. Preview and changes

During the drawing process, the customer receives a preview of the nearly finished portrait.

At this moment, small corrections are possible, such as:

  • minor adjustments in contrast or tonal value
  • small corrections to details

Major changes are not possible, including:

  • new poses
  • new reference photos
  • different compositions
  • redrawing the work entirely
  • adding new people or elements

The preview is intended for small refinements, not for a new commission or complete reworking of the portrait.

7. Turnaround time

The average total turnaround time is approximately 4 weeks.

The drawing process itself usually takes around 2 weeks. Extra time is needed for communication, finishing, packing and shipping.

For international shipping or carrier delays, delivery may take longer.

Rush commissions are not offered.

8. Shipping

The portrait is carefully packed with protective material and shipped securely.

Shipping costs are paid by the customer and calculated separately based on location and size.

Packaging, protective materials and possible frames may differ slightly depending on availability, size and shipping requirements.

After shipping, transport is the responsibility of the carrier. Although the work is packed carefully, the artist cannot be held liable for damage, loss or delays during transport.

9. Returns and refunds

Because every portrait is made specifically on commission, returns and refunds are not possible after approval of the preview and completion of the work.

10. Use and copyright

Copyright of the artwork always remains with the artist.

The portrait is intended for personal use only.

The customer may:

  • use the work at home
  • share the work on social media with credit to the artist

Commercial use is not allowed without prior written permission from the artist.

Commercial use includes, among other things:

  • business use
  • promotional use
  • merchandising
  • publications
  • branding
  • sale or reproduction

Additional agreements and rates may apply for commercial use.

11. Privacy and publication

Portrait commissions may contain personal images and sensitive reference photos. Work is never shared publicly without permission from the customer.

The artist may only use the work for portfolio, website or social media purposes when the customer has given permission.

Upon request, a work can be:

  • shared anonymously
  • partly made unrecognisable

During the request, the customer can indicate whether publication is allowed or not.

12. Customer response time

If a customer does not respond before payment of the deposit, the request is not considered a confirmed commission.

If a customer does not respond to the preview or outstanding final payment, the work will not be shipped until full payment has been received. Any delay caused by this is outside the artist's responsibility.

The artist also reserves the right to refuse commissions that do not fit the artistic style or vision of the work.

13. Right to refuse

The artist reserves the right to refuse commissions that:

  • are discriminatory
  • contain explicit sexual content
  • glorify senseless violence
  • could cause misuse of persons
  • contain inappropriate or hurtful content
  • involve celebrity portraits without clear permission or relation
  • otherwise do not fit the artist's artistic or ethical working method

14. Digital display

Due to differences in screen settings, photography and lighting conditions, tonal values, contrast and details of the original work may differ slightly from the digital display on the website or in previews.
